TERMS AND CONDITIONS:
All sales made by African Cowboy (’Seller’) to you (’Customer’) are governed by these Terms and Conditions unless otherwise indicated by African Cowboy in writing
PLEASE READ THESE TERMS AND CONDITIONS THOROUGHLY BEFORE PLACING AN ORDER. DO NOT PLACE AN ORDER UNLESS YOU UNDERSTAND THESE TERMS AND CONDITIONS AND AGREE TO ABIDE BY THEM. AFRICAN COWBOY RESERVES THE RIGHT TO AMEND OR MODIFY THESE TERMS AND CONDITIONS OF SALE AT ANY TIME AT ITS SOLE DISCRETION.
Sale is Contingent on Customer’s Acceptance of Terms and Conditions.
Seller shall not accept Customer’s purchase orders unless and until Customer consents to these Terms and Conditions of Sale. These Terms and Conditions of Sale (as set forth on this website) supersede the terms and conditions of Customer’s purchase order(s) and will govern all transactions between Customer and Seller. These Terms and Conditions of Sale also apply to all future transactions unless modified in writing signed by Seller and Customer.
Shipping Costs and Sales Taxes
We offer delivery to the United States only.
U.S. sales tax will be charged in accordance with the individual state regulations.
Allow 7 working days for delivery.
Please note that delivery to Post Office Boxes is not available.
Payment
Payments can be made by Visa, Mastercard, American Express and Discover.
Payment will be debited and cleared from your account upon receipt of your order. You confirm that the credit / debit card that is being used is yours. All credit / debit card holders are subject to validation checks and authorization by the card issuer.
If the issuer of your payment card refuses to authorize payment to AFRICAN COWBOY, we will not be liable for any delay or non-delivery.
We take all reasonable care to make our site as secure as possible. All credit card transactions on this site are processed using Authorize.net, a secure online payment gateway that encrypts your card details in a secure host environment. At AFRICAN COWBOY we do not hold your credit card details on the website or our customer database.
Furthermore, we will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the site.
Insurance
AFRICAN COWBOY insures each purchase during the time it is in transit until it is delivered to you. You will be asked to sign for any goods delivered at which point responsibility for your purchased goods passes to you.
Returns and Exchanges
We want you to be completely happy with your order, so all of our products carry a 30 day unconditional guarantee. All we request is that you first email us at info@africancowboyclothing.com with the reasons for your return or exchange.
All items for return or exchange merchandise may not be returned without prior authorization. To process a refund or exchange, we must first issue you a return authorization number.
Once the RA has been authorized you must display the RA number on the parcel being returned including copy of packing slip sent with original order.
We request that all goods are returned within 30 days of purchase. Returns received outside the above time frames are accepted at the discretion of AFRICAN COWBOY.
Customer Exchanges
We can only exchange an item for the same item in a different size, subject to availability. We are unable to process any exchanges for a completely different item.
Exchanged items can only be dispatched after the returned goods have been received and undergone a quality control check.
Exchanges received outside of the above stated timescales are also subject to product availability and the customer will incur any shipping costs for such exchanges.
AFRICAN COWBOY will not accept returns for any non-faulty items that have been worn and tags removed. Upon receipt of an order, if any item has been received with no tags, customer should notify us (by phone or email) on the same day if they wish to return.
We strongly advise all customers to check garments thoroughly upon delivery before removing any attached tags and before disposing of any original packaging.
In the event of any failure to return any goods to us within the stipulated time limits, even though validly cancelled, we shall have the right to charge any costs of recovery of the goods.
Faulty items will only be accepted if the goods are delivered to the customer damaged or there is a subsequent manufacturing fault within a period of 3 months after delivery. All items returned as faulty will be inspected and any items deemed to subject to fair wear and tear will not be accepted as faulty.
Receiving a refund
Refunds to you will be made within 30 days of the date of cancellation notice. All undamaged, correctly returned products will be credited to the original purchaser’s credit card including sales taxes, excluding shipping charges.
Disclaimer of Warranties
Seller cannot guarantee variations in color, shade, size and construction of merchandise. Seller hereby disclaims all express and implied warranties, including, without limitation, implied warranties of merchantability and fitness for particular purpose. All such warranties are hereby disclaimed and excluded from any and all transactions between customer and seller and shall not apply to the merchandise sold by seller.
Limitation on Liability
Customer acknowledges that seller shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages including but not limited to, damages for loss of profits, goodwill, or other intangible losses (even if seller has been advised of the possibility of such damages), or personal injuries or death resulting from use or sale of the seller’s merchandise.
No Liability for Outside Vendors
Seller shall not be liable for any work performed by any third party vendor referred by Seller and hereby waives any right to assert any claim against Seller for work performed by any other third party or vendor, including but not limited to claims for negligent referral, agency, or respondent superior.
